Terms of Use

1. GENERAL TERMS OF PURCHASE

These terms (the “Terms of Purchase”) ensure your satisfaction and understanding of the purchase process for Hildervat events (“Hildervat,” “we,” “us,” “our”). If you have any questions, please contact us at info@hildervat.com. Your purchases on any site used to register for a Hildervat event (collectively, the “Sites”) are subject to these Terms of Purchase.

2. AUTHORITY TO REGISTER AND ACT AS AGENT

You represent and warrant that you have full legal authority to complete the registration for the event (“Event Registration”), including accepting these Terms of Purchase, on behalf of yourself and/or any party for whom you are registering (the “Registered Parties”).

By proceeding with Event Registration, you agree that these Terms of Purchase shall apply equally to all Registered Parties. You agree to indemnify, defend, and hold Hildervat harmless from any liability arising from claims made by a Registered Party.

If you are registering a minor, you confirm that you are their parent or legal guardian and have the authority to agree to these Terms of Purchase on their behalf.

3. PAYMENT METHODS

Payment methods vary by booking platform. Please refer to the relevant booking platform for further details.

4. PRICING, FEES, AND AVAILABILITY

Hildervat may charge various fees associated with Event Registration:

• Event Registration Fee: Charged for participation in the event. Pricing may vary by event location, availability, and selected start time.
• Processing Fee: Charged for handling registration transactions. This fee is non-refundable.
• Administrative, Insurance, and Management Fee: Covers event-related costs such as administration, insurance, and risk management.
• Parking & Bag Drop Fee: Covers general parking and bag drop services on-site.

All fees are subject to applicable taxes.

5. EVENT REGISTRATION EXPIRATION

Unused Event Registrations expire at 11:59 PM on the Friday after the event unless transferred or deferred per Sections 8 and 9.

6. PHOTO CAPTURE AND PURCHASES

By participating in an event, you agree to allow Hildervat and its photography service providers to capture and use your image in promotional materials. Photos purchased are non-transferable and non-refundable.

7. CANCELLATIONS AND RESCHEDULED EVENTS

Events may be canceled due to circumstances beyond Hildervat’s control, including but not limited to severe weather, government regulations, or safety concerns. In such cases:

• You may transfer or defer your registration to a future event.
• No refunds will be provided for rescheduled events.
• Hildervat is not liable for any travel or accommodation expenses related to cancellations.

8. REFUNDS

All sales are final. Hildervat does not offer refunds for any fees unless:

• A refund is requested within 48 hours of purchase for unused registrations.
• The participant is unable to attend due to military deployment.

Refunds will not be provided for promotional codes, discount registrations, or unused entries.

9. TRANSFERS

Participants may transfer their registration under the following conditions:

• To a Different Start Time: Must be completed online by 11:59 PM on the Friday before the event.
• To Another Event: Subject to a transfer fee and availability.
• To Another Person: Requires a transfer request and fee. Deadline for person transfers is two Fridays before the event.

10. ASSUMPTION OF RISK AND CONSENT TO MEDICAL CARE

OCR events involve inherent risks. By participating, you assume all risks and acknowledge that Hildervat is not responsible for any injuries, medical expenses, or property damage. You consent to emergency medical care if necessary.

11. LIMITATION OF LIABILITY

Hildervat is not liable for any:

• Lost profits, reputational harm, or business disruptions.
• Injuries, accidents, or damages incurred before, during, or after the event.
• Technical errors or registration issues.

Our total liability shall not exceed the amount paid for Event Registration.

12. INDEMNITY

You agree to indemnify and hold Hildervat harmless from any claims, damages, or legal actions arising from your participation in an event.

13. RECORDING, TRANSMISSION, AND PUBLICITY RIGHTS

By attending, you grant Hildervat unlimited rights to use your image, name, and likeness in event promotions, media, and marketing materials.

14. SAFETY AND SECURITY

Hildervat reserves the right to:

• Search participants and their belongings.
• Deny entry to individuals violating safety regulations.
• Enforce event rules for participant safety.

15. SEVERABILITY

If any part of these Terms of Purchase is deemed invalid, the remaining sections remain in full force.

16. GOVERNING LAW

These Terms of Purchase are governed by the laws of the United States. Any disputes shall be resolved in accordance with U.S. law.

17. CHANGES TO TERMS

Hildervat may update these Terms of Purchase at any time. Your continued participation constitutes acceptance of any revised terms.
